US Moves to Ease Concerns Over Green Card Rule Changes
The clarification came after questions were raised over new guidance issued by the US Citizenship and Immigration Services, which had sparked fears that a large number of applicants might be required to leave the country and complete their immigration procedures through US consulates abroad, according to media reports.
The earlier guidance was seen as tightening rules on “adjustment of status,” a process that allows certain immigrants sponsored by employers or family members to remain in the country while their residency applications are processed.
Following criticism from immigration attorneys, business organizations, and advocacy groups, the Department of Homeland Security said the policy simply reflects “longstanding law and policy.”
“The policy will not prevent any alien from obtaining a green card who legitimately and properly qualify,” the department was quoted as saying in reports.
It further stated that the update “will have no noticeable impact on highly qualified applicants and skilled professionals who have followed the law.”
However, former USCIS chief counsel Lynden Melmed noted that the latest clarification appears to narrow the interpretation of the original guidance, raising ongoing questions about how the policy will be applied in practice.
