Jury Rejects Elon Musk’s Lawsuit Against OpenAI

(MENAFN) A federal jury in the United States has dismissed a lawsuit filed by Elon Musk against OpenAI CEO Sam Altman and several company executives, according to multiple reports released Tuesday.

Musk had accused Altman, OpenAI president Greg Brockman, and others of transforming OpenAI from a nonprofit research organization into a company focused on generating profits for executives and investors.

According to reports, Musk stated in the lawsuit that he invested $38 million in the company during its early years and sought damages worth $150 billion. He also requested the removal of OpenAI’s current leadership, while reportedly pledging to donate any awarded compensation to the organization’s nonprofit division.

The decision was issued Monday after a nine-member jury concluded that Musk had filed the case too late and failed to meet the legal time limit required for the claims. Although the jury’s role was advisory, Judge Yvonne Gonzalez Rogers later accepted the recommendation and formally dismissed the lawsuit.

Lawyers representing OpenAI argued that Musk’s real objective was to gain control of the company. According to reports citing court proceedings, executives informed Musk as early as 2017 that OpenAI would require funding structures associated with a for-profit model in order to continue developing advanced artificial intelligence systems.

Reports also stated that Altman testified Musk once demanded a 90% ownership stake in OpenAI and proposed merging the organization with Tesla. Musk reportedly argued at the time that such a merger would secure the large-scale financial backing the company needed.

OpenAI chairman Bret Taylor also reportedly told the court that the company received a formal takeover proposal in February 2025 from a group led by Musk’s AI firm xAI, months after the lawsuit was filed.

Following the verdict, Musk criticized the ruling on X, writing that “Altman and Brockman did in fact enrich themselves by stealing a charity.”

“The only question is WHEN they did it!” he added, while promising to appeal the decision, which he described as “incredibly destructive and creating a precedent to loot charities.”
